THE OSHA STANDARD
As defined in 29 CFR 1910.1200 (c), an article is 鈥溾? manufactured item other than a fluid or
particle: (i) which is formed to a specific shape or design during manufacture; (ii) which has
end use function(s) dependent in whole or in part upon its shape or design during end use; and
(iii) which under normal conditions of use does not release more than very small quantities, e.g.,
minute or trace amounts of a hazardous chemical (as determined under paragraph (d) of this
section), and does not pose a physical hazard or health risk to employees.
CONCLUSION
Many products manufactured or marketed by DeRoyal do not include an MSDS in the
packaging as they are considered whole units or 鈥渁rticles鈥? as per the Hazard Communication
Standard. As such, an MSDS is not required for these products. While many of the products
that DeRoyal manufactures are produced from raw materials that are fluids or particles, once
formed into a whole unit, the material cannot be spilled, consumed, ingested, inhaled, or
absorbed. Examples include light handle covers, suction canisters or needle counters. These
products are made from raw materials that are considered particles or liquids. DeRoyal
maintains the MSDS on file for the respective raw materials for the safety of our employees.
Once these raw materials are fabricated into the finished device, however, the potentially
hazardous nature of the raw material is rendered irrelevant as the chemical cannot be released.
Other finished products that DeRoyal manufactures and markets that are considered particles or
liquids do have an MSDS available. Examples would be DeFogger鈩?, Solidifier and
Multidex庐. The MSDS for these products can be found on our web site at www.deroyal.com.
